  • ADDITIONAL REPRESENTATIVE MEDIA CASES

  • Randolph v. Dolcefino, et al., 19 S.W.3d 906 (Tex. App.-Houston [14th Dist] 2000, pet. denied) Counsel for defendant investigative reporter and television station in libel action brought by former city controller of Houston, and one of his employees, for a series of investigative reports on the controller's work habits. The Houston Court of Appeals refused to find that there could be libel by implication when the actual statements made in a television broadcast were true, and reversed the denial of a motion for summary judgment on behalf of defendants.

  • Abdel-Hafiz v. ABC, et al. (State District Court, Fort Worth, Texas 2007) Obtained summary judgment for ABC and its investigative reporting team, led by Brian Ross, in case brought by FBI agent relating to story on FBI failures prior to 9/11. Summary judgment upheld on appeal. 240 S.W. 3d 492 (Tex. App.—Fort Worth 2007, pet. denied).

  • American Ecology Environmental Services Corporation, et al., v. Mildred Krueger, et. al., Civil Action No. 3-96 CU 2670-D, in the United States District Court for the Northern District of Texas, Dallas Division (settlement reached and dismissal of libel case against community interest group).

  • Ella Collins Nelson v. Lin Corporation and KXAS, Civil Action No. 4-98-CV-0160Y, in the United States District Court for the Northern District of Texas, Fort Worth Division (summary judgment for defendant television station in libel case).

  • Pitney v. Azle News Advertiser, Cause No. 67-76490-83, in the 67th Judicial District Court of Tarrant County, Texas (jury verdict for defendants in libel case).

  • Waddell v. Fox Entertainment Group, Civil Action No. 3:06 – CV-2387-M, in the United States District Court for the Northern District of Texas, Dallas Division (summary judgment granted in favor of Fox News on investigative report into misuse of government loan program designed to benefit businesses affected by 9/11 attacks).

  • John Shike v. KGOL, et al., Cause No. 1999-11179, in the 234th Judicial District Court of Harris County, Texas (dismissal of libel case against radio station KGOL).

  • T.J.S. and T.S. as Next Friends of M.S. v. Clear Channel Communications, et al., Cause No. GN0-00518, in the 53rd Judicial District Court of Travis County, Texas (settlement reached in libel case against Austin radio station).

  • Little Saigon Radio Broadcasting, Inc. v. Douglas Broadcasting, Inc., Cause No. 97-45719, in the 190th Judicial District Court of Harris County, Texas (settlement reached and dismissal of defendants after denial of temporary injunction in Lanham Act and unfair competition case regarding radio station programming).

  • The Perry Company v. Arnold Communications, in the County Court-at-Law of Dallas County, Texas (favorable settlement reached for advertising client).

  • Eckerd Corporation v. Fox Television Stations, Cause No. 99-02932-E, in the 101st Judicial District Court of Dallas County, Texas (successfully opposed request for prior restraint of news story by television station).

  • State of Texas v. Lyon, Cause No. F-9141619, in the Judicial District Court of Dallas County, Texas, 19 Media L. Rep. 2153 (1991) (quashed subpoena for outtakes and reporters notes).

  • ADDITIONAL REPRESENTATIVE INTELLECTUAL PROPERTY CASES

  • DR Systems, Inc. v. ScImage, Inc., Brit Systems, Inc. et al. (United States District Court for the Southern District of California 2006). Counsel for defendants Brit Systems, Inc. and ScImage, Inc. in this patent infringement case brought in San Diego, California, regarding automated medical imaging and archival systems. The case against ScImage and Brit was dismissed.

  • InternetAd Systems, LLC v. ESPN, Inc., The New York Times, et al. (United States District Court for the Northern District of Texas 2000). Counsel for defendants ESPN and The New York Times Company in patent infringement case involving patents on pop-up ads that appear on websites. Case settled.

  • Texas Hot Looks, Inc. v. CNN., et al. (United States District Court for the Northern District of Texas 2000). Counsel for a number of media defendants in this copyright action involving photographs. Obtained settlements on behalf of CNN, ABC and Newsweek.

  • Comarco Wireless Technologies v. Mobility Electronics et al. (United States District Court for the District of Arizona 2003) Counsel for Mobility Electronics in this patent infringement case involving power adapters for portable electronic devices. Following an evidentiary hearing, after which the court gave credence to Mobility's invalidity defense, the court denied the plaintiff's request for injunctive relief. The lawsuit settled shortly thereafter. The denial of the injunction allowed Mobility's flagship product, a combination AC/DC power adapter, to stay on the market.

  • Affinity Labs of Texas LLC v. DICE Electronics LLC, et al. (United States District Court for the Eastern District of Texas – Lufkin 2009). Counsel for defendant DICE Electronics in patent infringement case involving a patent directed to system and method for connecting a portable audio player to an automobile sound system. Settled on behalf of DICE Electronics.

  • Data Management, Inc. v. Control Module, Inc. (United States District Court for the Northern District of Texas – 2009). Counsel for Data Management, Inc. in a declaratory judgment suit over alleged trade secrets in computerized time and attendance solutions. Case settled.

  • Wireless Agents, L.L.C. v. Siemens Communications, Inc. (United States District Court for the Northern District of Texas 2005). Counsel for Siemens in patent infringement case involving handheld wireless communication devices. Case against Siemens dismissed.

  • Joint Marketing International, Inc., et al. v. Walgreen Company (United States District Court for the Eastern District of Texas 2008). Counsel for defendant QVC Inc. in this patent infringement lawsuit concerning a device that cleans eyeglasses. Case settled on behalf of QVC.

  • Phoenix IP LLC v. Honeywell International and Cadence Network Inc. (United States District Court for the Eastern District of Texas 2007). Counsel for defendant Cadence Network in suit alleging infringement of patent directed to a computer-based system for generating customized proposals relating to consumption and cost of utilities. Case settled on behalf of Cadence Network.

  • Brown, et al. v. Greene, et al. (United States District Court for the Southern District of Texas 2000). Counsel for defendants Jerry and Nina Greene, individually, and Collectables Records in this copyright, trademark and right of publicity case that was tried to a jury over two and a half weeks in which the plaintiffs sought $16 million in damages. The verdict and judgment were generally favorable to Collectables and a directed verdict was entered for the Greenes.

  • DataTern Inc. v. Bank of America Corporation, et al. (United States District Court for the Eastern District of Texas – Texarkana 2009). Counsel for QVC in a patent infringement case concerning a patent directed to a system for enabling access to a relational database. Settled on behalf of QVC.

  • Little Saigon Radio Broadcasting, Inc. v. Douglas Broadcasting, Inc. (State District Court, Houston, Texas 2000) Counsel for defendants in Lanham Act and unfair competition case involving foreign language radio station programming. Successfully defended against request for injunctive relief. Case ultimately settled and dismissed.

  • E-Data Corp. v. The New York Times, et al. (United States District Court for the Eastern District of Texas 2005) Counsel for The New York Times, defending a claim for patent infringement on a matter involving systems for reproducing information in material objects at a point-of-sale location. On motion by the Times, the case was transferred to the Southern District of New York.

  • Globalaw, Inc v. Globalaw, Ltd. et al. (United States District Court for the District of Columbia 2006) Counsel for a defendant in this trademark and tradename dispute. Summary judgment granted for defendants.

  • Mobility Electronics, Inc. v. SBS Technologies, Inc. (United States District Court for the District of Arizona 2003). Counsel for Mobility Electronics in this patent infringement suit involving split bridge technology for portable computer interfaces. Case settled.
